When do I need notary?

A notary is required to impartially witness the signing of legal documents and to attest that the person who is signing the document presented identification to verify their identity.

Notarization is needed when handling
- Administer oaths and affirmations (including oaths of office)
- Taking affidavits and depositions
- To receive and certify acknowledgments
- To receive and certify proofs (of execution) of deeds, mortgages and powers of attorney
and other instruments in writing.
- To demand acceptance or payment of foreign and inland bills of exchange, promissory notes and obligations in writing.
- Required attendance at the forced opening of an abandoned safe deposit box to observe the opening and conduct and provide a written inventory of the contents.

Don't Sign Yet!

For a Notary Public to notarize your signature, you must be in the presence of the Notary. Generally speaking, it is best to wait until the Notary tells you that you can sign, as you may need to swear an oath first, for example. Your signing of the document may not be accepted in your particular circumstances. If possible, bring a spare copy, just in case.
